About the project

The purpose of our project is to build a real wall calledBrixWall&nbsp(though virtual), where every person from our planet may not only write, share his thoughts, congratulate, confess his love, express condolences and express himself in any other way, but also express his attitude (positive or negative) to notes or pictures (photographs) of other people.

Any user may freely view the wall, even without registration at our site, and share the links to the bricks he liked in social networks.

Notes may be made only on the bricks that are located near to the filled in bricks. As far as all free bricks are being filled in, the wall will be getting bigger.

Terms and Conditions of using the BrixWall website

By accessing and using the BrixWall website, you consent to and acknowledge these terms and conditions.

1. Principal conditions

You will be responsible for using the BrixWall website, all content posted by you on our website, including for all consequences of its use and posting. Most part of the information that you transfer, post or provide for publication on the BrixWall website, is publically available by default and may be viewed by other users.

You may use the BrixWall website only in accordance with these conditions and all applicable local, regional, national and international laws, norms and regulations.

2. Confidentiality

You understand that by using the BrixWall website you consent to collection and use of this information, including to transfer of this information to other countries for storage, processing and use by BrixWall.

Personal data: when registering at our website, you provide us the information about you accounts in social networks or the email. We may use and store this information for improvement of quality.

Information about location: BrixWall may receive the information about your location using your IP-address. We may use and store the information about your location for improvement of quality.

Laws and indemnification: Despite any provision of these conditions to the contrary, we reserve the right to keep confidential or disclose your information, if we have reasons to believe that such actions comply with the laws, bylaws; to ensure security of any person; to counteract any fraudulent actions; for security purposes or for technical reasons; to protect rights of BrixWall.

Children policy: Our site may not be used by children under the age of 14 years.

3. Accounts/Passwords

You will be responsible for ensuring safety of the password used for accessing the BrixWall website and for all operations and actions performed under your password and/or your account in social networks (if you register through it). In order to protect your account we recommend to use “secure” passwords (that consist of upper and lower case characters, figures and special characters). BrixWall may not and will not be responsible for any losses or damage arising out of failure to comply with the requirements and recommendations mentioned above

4. Content in Services

The author of the content alone will bear full responsibility for the content that was made publically available. We may not control the content posted using the BrixWall website and may not assume responsibility for such content. You will use and rely on any content or materials published using the BrixWall website or obtained by you using the BrixWall website at your own risk.

We will not confirm, support or guarantee completeness, credibility, accuracy or authenticity of any content or messages posted using the BrixWall website, nor declare thereof, and will not confirm any opinions expressed using the BrixWall website. You acknowledge that when using the BrixWall website, you may encounter the content that may seem to you offensive, defamatory, unreliable or unacceptable for other reasons. BrixWall will in no case be responsible for the content, including but not limited to errors or omissions in any content, as well as damage or losses of any kind incurred as a result of use of such content posted using the BrixWall website or distributed otherwise.

When sending, publishing or posting the content using the BrixWall website, you will provide us with a global non-exclusive gratuitous license (with the right to grant a sublicense to the third parties) for the use, copying, reproduction, processing, adaptation, change, publishing, transfer, display or distribution of such content in any sources and by any means of distribution (presently known or developed in future), including for the purpose of generation of profit.

You understand that your content may be acquired, transferred, distributed or published by us or our partners, and if you are not entitled to provide the content for such use, you may bear responsibility for that. You represent and guarantee that you have all rights and powers necessary for granting rights for any content provided by you in accordance with these conditions.

5. Restrictions in respect of the Content and the use of Services

In order to ensure convenience and safety BrixWall applies certain restrictions for the content type. These restrictions are compulsory for all users and failure to comply with these restrictions may entail temporary blocking of accounts of the violator and /or full deletion thereof.

Restrictions for the use of BrixWall:

• Illegal use. It is prohibited to use BrixWall for illegal purposes or for aiding illegal actions. Users agree to comply with all local laws regulating behavior in the Internet and the use of allowed materials.
• Rudely naturalistic images. It is prohibited to publish at BrixWall rudely naturalistic images, including pornography, scenes of violence, death images, etc.
• Copyright. When posting the content at BrixWall, it is prohibited to violate copyrights of the third parties.
• Threats of violence. It is prohibited to publish threats of violence in respect of other persons, including terrorism, and to promote violence.
• Harassment. It is prohibited to purposefully offend and harass other users or third parties.
• Kindling hatred. It is prohibited to promote violence, assault other people or threaten with violence on the grounds of race, ethnicity or nationality, sexual orientation, sex, gender identity, religious views, age, limited physical or mental capabilities or diseases. Also, the accounts the main purpose of which is incitement to causing harm to other people on the grounds of any of the above mentioned characteristics shall are prohibited.
• Improper use of several accounts. It is prohibited to create several accounts for the purpose of repetition of any actions or in order to bypass temporary or final suspension of a certain account.
• Confidential information. It is prohibited to publish or post private and confidential information of other persons, such a credit card number, insurance policy number or national identification number without express consent of such persons. Besides, it is prohibited to publish photographs or videos of intimate character which are created or distributed without consent of persons represented on these photographs.
• Impersonation. It is prohibited to impersonate using BrixWall services, if such impersonation leads to misrepresentation or deception of other persons or is intended for these purposes.
• Malicious software and phishing. It is prohibited to publish or post links to malicious content intended for causing harm to the browser or other user’s computer, and for unauthorized disclosure of confidential information of other users.

6. Copyright compliance policy

BrixWall respects intellectual property rights of other persons and expects the same from users of the BrixWall website. We will respond to notices of alleged violations of copyrights that correspond to the applicable laws and that are properly submitted to us. If you think that your content was copied and such copying constitutes violation of copyrights please provide us with the following information: (i) autographic or electronic signature of the owner of copyrightd or a person entitled to act on his behalf; (ii) definition of the work protected by the copyright, the right to which, as alleged, was violated; (iii) definition of the material which, as alleged, violates rights or is the subject of violation, and which should be deleted or the access to which should be prohibited, as well as the information that makes it possible for us to find this material; (iv) your contact information, including postal address, telephone number and email; (v) application on the fact that you have grounds to believe that the use of the material specified in the claim is prohibited by the owner of copyrights, his agent or by virtue of laws; and (vi) application on the fact that the information specified in the notice is true and that you understand the responsibility for provision of knowingly false information and are entitled to act on behalf of the owner of copyrights.

We reserve the right to delete the content that allegedly violates copyrights without preliminary notification at our own discretion without any obligations to you. In respective cases BrixWall will also close the user’s account, especially if the user repeatedly commits violations.

7. Disclaimers and limitation of responsibility

The content on the BrixWall website may contain links to websites or resources of the third parties. You acknowledge and agree that BrixWall does not bear responsibility for: (i) availability or accuracy of these websites or resources; or (ii) the content, products and services available at such websites or resources. Links to such websites or resources do not imply that BrixWall approves such websites, resources or content, products or services available at such websites or resources. You acknowledge that you bear personal responsibility and assume all risks arising in connection with the use of any such websites or resources.

8. Applicable laws

These conditions and all legal actions related thereto are regulated by the laws of the Russian Federation.
